1. Acceptance of terms
By creating an account and using the platform accessible via private link (the "Platform"), operated by SC BEAUTY & WELLNESS SRL, with its registered office in Cugir, Ioan Budai Deleanu St. no. 5, Romania ("we", "the Operator"), you agree to these Terms of Service. If you do not agree, please do not use the Platform.
2. Description of the service
The Platform allows registered users to voluntarily participate in questionnaires and product studies. The service is provided free of charge, for product research purposes, unless otherwise stated.
3. Eligibility and account
You must be at least 18 years old to create an account. You are responsible for the accuracy of the data you provide, for the confidentiality of your password, and for all activities carried out through your account. You must notify us immediately at gdpr@bwcounter.com in case of unauthorized use. Access is granted exclusively via private link, which you agree not to share with unauthorized persons.
4. User obligations
You agree to: provide accurate and truthful information; use the Platform only for lawful and compliant purposes; not attempt to gain unauthorized access to our systems; not upload illegal, offensive, or infringing content. You provide your responses, including any sensitive data, voluntarily and at your own responsibility.
5. Processing of personal data
The processing of your data is described in our Privacy Policy and GDPR notice, which form an integral part of these Terms. By using the Platform, you confirm that you have read and understood these documents.
6. Intellectual property
The Platform, its structure, design, logos, and proprietary content are the property of the Operator and are protected by intellectual property law. You may not copy, modify, or distribute these elements without our written consent.
7. Use of responses and results
The responses you provide in the studies may be used, in aggregated and/or anonymized form, for product research purposes and may be shared with the third-party partners/clients mentioned in the GDPR notice, within the limits of your consent. You do not claim ownership rights or compensation over the research results derived from the responses provided.
8. Suspension and termination
We reserve the right to suspend or close an account that breaches these Terms, without prior notice. You may request deletion of your account at any time by writing to gdpr@bwcounter.com.
9. Limitation of liability
The Platform is provided "as is", without warranty of uninterrupted availability or error-free operation. To the extent permitted by law, the Operator is not liable for indirect or incidental damages, or for losses resulting from the use of or inability to use the Platform. Nothing in these Terms limits liability that cannot be excluded by law (e.g. in case of willful misconduct or gross negligence).
10. Changes to the terms
We may update these Terms at any time. Changes take effect upon publication on the Platform, with the date of last update indicated. Continued use after changes constitutes acceptance of the new terms.
11. Governing law and jurisdiction
These Terms are governed by Romanian law. Any dispute shall be settled by the competent courts in Romania, without prejudice to your rights as a consumer to bring proceedings in your country of residence.
